Introduction
We reserve the right to change these terms and conditions from time to time by changing them on the Site, although no such change will affect any order you have already placed with us.
Use
You will primarily use the vehicle as a private hire vehicle. You shall pay fines, charges, or fees relating to the vehicle and carry all liability for such offences. You will adhere to the mileage cap; otherwise, you will promptly pay the excess mileage fees. Failure to do so will allow us to immediately cancel the permission to drive the vehicle and require the return of the vehicle within 48 hours. The driver is not allowed to give the vehicle to any other driver or use it for any other purpose without notifying us. The vehicle is not allowed to be taken out of the country.
Prices
The weekly cost of Packages is as quoted on the Site from time to time. We reserve the right to change prices of Packages without notice. We will not enforce any pricing changes on existing Contracts, and the price on your Contract will always remain the same unless your Contract is amended in any way. Packages can have different features (such as Contract length) and additions (such as insurance and breakdown cover) and are subject to change.
Payment
We do not accept credit cards or debit cards for regular payments. Debit cards may be used only to verify your identity through a small payment if necessary. All regular payments must be made by standing order with confirmation provided by bank transfer to our nominated bank account.
Fees & Charges
Failure to pay any outstanding sums within 4 working days will lead to the termination of the permission to drive the vehicle at our discretion, but you will remain liable for the financial aspect of the contract.
Insurance
The insurance must be covered by the driver at all costs. We require confirmation from the insurance company that they will not cancel the policy without notifying us. In the event of an accident, the driver must continue paying the rent and follow the terms and conditions as per the contract until the vehicle has been repaired or replaced by either the driver, the third party, or their insurance. The driver must ensure that we are at no loss whatsoever and we are not held accountable for any of their actions. The driver is not allowed to instruct or hire or avail services of any third party for processing any vehicle damage or any accident that has occurred. We will deal with our own accidents and our own damages or any party instructed by us.
Cancellation & Refunds
You are not allowed to cancel the contract within the first year for new vehicles. After the initial one-year term, you may give a 28-day notice to cancel the contract. Any payments made will be refunded accordingly, subject to our terms.
Contract Termination
We do not tolerate any unprofessional behaviour or illegal activity. If the contract terms and conditions are not followed, the permission to drive will be terminated, but the driver remains financially liable for the contract. We will recover the vehicle immediately. If payments are not brought up to date within 24-48 hours, the permission to drive is terminated, but the financial liability remains. If the vehicle cannot be recovered, it will be reported stolen. This will be reported to TfL, which may result in the cancellation of the driver’s PCO licence. Any fraudulent activity will be reported to TfL, potentially resulting in the termination of the PCO licence.
Accidents & Damage Reporting
The driver is responsible for regular maintenance and repairs of the vehicle. The vehicle must be kept in good working condition, and regular check-ups must be performed at approved service centres as specified by us.
Data Privacy
We handle the driver’s personal and payment information in accordance with GDPR and our Privacy Policy, ensuring the protection and confidentiality of your data.
Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations under this contract if such failure or delay is caused by circumstances beyond their reasonable control, including but not limited to acts of God, war, riots, and other force majeure events.
Dispute Resolution
Any disputes arising out of or in connection with this contract shall be resolved through mediation or arbitration before proceeding to litigation.
Governing Law
This contract is governed by the laws of England and Wales. Any legal disputes shall be subject to the jurisdiction of the courts of England and Wales.
